LITIGATION SERVICES

Sometimes the best settlement can be achieved only if the right expert gets involved during the litigation phase.  Whether your case needs an analysis of potential damages, a mathematical model that determines damages, or a breakdown of class demographics, CAA can help.

Below is an overview of some of Class Action Administration's litigation services.

Venue analysis

The Class Action Fairness Act (CAFA) identifies several new criteria for assessing proper venue.  Early discovery will need to determine the demographics of the class as a result.   CAA is positioned to assist the parties with many of these analyses.  We have the database skills, analytical experience and expert credentials to help determine the nature of the class, and have proven our independence through our work as a class administrator.

Assess Available Data Sources

With today's technology, information that can be used in a class action is often stored in corporate information systems. We have extensive experience with enterprise systems and with the methods of identifying, obtaining and understanding the information they store. During discovery, this capability can save critical time and help control costs.

Damage Calculations

Our team's sound business background and experience in building analytical systems allows us to create damage models which accurately reflect the facts of the case.  As we build the damage models, we can foresee how the model might be implemented in a settlement administration.  This allows us to transition smoothly from litigation support into settlement administration without a costly and time-consuming knowledge transfer from damage expert to class administrator.  For one damage model, CAA developed the methodology for calculating billing discrepancies using 200 million cellphone call records.

Expert Testimony

CAA can provide expert testimony regarding the damage models we have created, as well as regarding allocation methodologies, proposed notice and settlement administration plans, and other class administration issues that can arise during litigation.
